Civil Service Commission Will Hear Foley Termination Case in August

 


DAYTON—Former Columbia County Sheriff’s Deputy Don Foley appeared before the Columbia County Civil Service Commission on Monday to discuss his termination by Sheriff Rocky Miller last month.

At the meeting, Foley requested a continuance in the matter to allow his attorney, David Rose, adequate time to prepare for a hearing. The Commission agreed, and a date for the hearing will be set between August 6 and August 23.

Foley was terminated “for cause” by Miller on May 15, 2018, according to County Prosecuting Attorney Rea Culwell. That same week Foley filed to appear on the August primary election ballot to run for county sheriff in the November 2018 election.

Culwell said an investigation by the Sheriff’s office found that Foley had falsified time sheet entries “numerous times” during the months of January and February, 2018.

Foley described his termination from the Sheriff’s Department as “wrongful” in an interview with the Times on May 31. During that interview, Foley said he had been off work since January 2017 because of injuries he sustained while on the job.

Attorney Suzanne Michael will represent the Sheriff’s Department in the proceedings, said County Deputy Prosecuting Attorney Dale Slack.
