Trials Set:

Eric Ryan Vanzandt, 31, Dayton; entered not guilty plea to one charge of escape from community custody. Vanzandt failed to make himself available for DOC supervision. He is held on $10,000 bail. Trial set for Oct. 15-16.

Sentencing/Plea Agreements:

Anthony J. Nieto, Sr., 56, Dayton; plead guilty to a reduced charge of one count of assault in the third degree – criminal negligence and a weapon, a Class C felony. Nieto was originally charged with first degree assault following an incident in Nov. 2014, in which Tysen Beckner was stabbed in the neck. Nieto was sentenced to 16 mos. with credit for time served and handed over to the Department of Corrections.

Dewey D. Bell, 74, Dayton; accepted a plea agreement with reduced charges. Bell previously pleaded not guilty to charges of first-degree animal cruelty, a Class C felony, and unlawful aiming or discharge of a firearm, a gross misdemeanor. A neighbor alleged Bell shot their dog in the eye with birdshot in June. Bell alleged the dog was being aggressive toward him and his wife and that he intended to shoot it in the backside. Bell accepted a plea agreement dismissing count two and reducing count one to animal cruelty in the second degree, a gross misdemeanor. The case will be dismissed without prejudice at the time that all restitution for veterinary expenses is made for injuries sustained as a result of the shooting.

Mathew Turner Boulanger, 38, Columbia, Mo.; case dismissed without prejudice. Boulanger was charged with theft in the second degree and malicious mischief relating to the allegedly illegal collection of artifacts from the Umatilla National Forest in 2013 during an archeological survey.

Dave N. Schmitt, 55, Texas; case dismissed without prejudice. Schmitt was charged in July with second-degree theft and second-degree malicious mischief relating to the allegedly illegal collection of artifacts from the Umatilla National Forest in 2013 during an archeological survey.

Christina L. Johnson, 46, Starbuck; accepted a global plea agreement. Johnson was charged with second-degree assault, a class B felony; driving under the influence (DUI), a gross misdemeanor; disorderly conduct for abusive language; and contempt of court. Upon successful completion of an inpatient alcohol treatment program of at least six months and continued compliance with aftercare, the state will agree to amend count two to reckless driving, and accept guilty pleas to counts two and four. Johnson will be responsible for financial legal obligations of $1507.50.

Other Legal Action:

Brandon W. John, 32, Dayton; entered waiver of speedy trial in order to allow defense time to investigate. John faces two charges of first-degree escape for leaving a treatment center and not reporting to the Columbia County Sheriff’s Office. Trial reset to Oct. 21.

Jackson G. Miller, III, 46, Dayton; amended conditions of release to allow muzzle loader hunting and non-harvest daytime access to shop area across the street from the alleged victim’s home.

Steven D. Peterson, 52; re-set trail date for charge of 2nd degree assault strangulation – domestic violence. Trial reset to Oct. 14-16.

Marshall Hernandez, 54; trial reset because defense needs assistance contacting witnesses. Hernandez is charged with arson, reckless burning, and possession of stolen property. Trial reset for Oct. 21.

Andrew J. Churchill, 43; approved order to rescind a domestic violence no contact order, at victim’s request, imposed from an incident that occurred in January. A previous request to rescind had been made in July and denied.
